Ms.B.Dharani, learned counsel appearing on behalf of Mr.K.Mylsamy, learned counsel on record for R1 puts up a stiff defence stating that no proof has been placed by the petitioner to explain the delay of 63 days in filing the Writ Appeal. She would submit that every day's delay has to be explained and the State has not discharged its burden in this case.

2. Mr.Abdullahag, learned counsel who undertakes to file vakalat for R2 does not express any objection to the condonation of delay.

3. Having regard to the rival contentions and the explanation set out in the accompanying affidavit, we are inclined to condone the delay of 63 days in filing the Writ Appeal.

4. Accordingly, the delay is condoned and this Miscellaneous Petition is ordered.

5. Registry is directed to number the Writ Appeal, if it is otherwise in order, and list the same for admission. Let the names of the learned counsel for the respondents will continue in the cause list as and when the appeal is listed for admission.
