Respondents PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to disburse the medical reimbursement for which the petitioner is eligible under the Tamil Nadu Government pensioner's Health Fund Scheme in view of the representation dated 23.05.2016 by appreciating the above stated facts. By consent, the Writ Petition is taken up and disposed of at the stage of admission itself.

2.This Writ Petition has been filed to issue a Writ of Mandamus, to direct the first respondent to disburse the medical reimbursement for which the petitioner is eligible under the Tamil Nadu Government pensioner's Health Fund Scheme in view of the representation dated 23.05.2016.

3.The petitioner joined service as Junior Assistant in the Revenue Department on 16.08.1976 and retired as Tahsildar on 31.03.2010. According to the petitioner, his wife underwent a cataract surgery in her right eye on 20.03.2014 and hence, he made representation to the first respondent for medical reimbursement but till date no orders have been passed and https://hcservices.ecourts.gov.in/hcservices/

hence, the Writ Petition has been filed.

4.Mr.M.Guruprasad, the learned counsel for the petitioner would submit that the petitioner would be satisfied, if his representation is directed to be considered and appropriate orders are passed as expeditiously as possible. 5.Mr.S.Gunasekaran, learned Additional Government Pleader for the respondents has got no serious objection for directing the first respondent, who is the competent authority to consider the representation of the petitioner and pass appropriate orders, on merits and in accordance with law. 6.Considering the submissions made on either side, this Court, without going into the merits of the claim made by the petitioner, directs the first respondent, to consider the representation of the petitioner, dated 23.05.2016, and pass appropriate orders, on merits and in accordance with law, within a period of two months from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion with regard to the merits of the claim made by the petitioner.
