O R D E R

This criminal original petition has been filed to modify the bail order dated 21.10.2016 in CMP.5163 of 2016 in Crime No.668 of 2016 on the file of the Judicial Magistrate No.1, Poonamalli.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. It is seen that the petitioner was arrested on 05.09.2016 for offence under Section 392 IPC and released on bail on 21.10.2016 by the Judicial Magistrate No.1, Poonamalli in Crl.MP.No.5163 of 2016 on condition that he should execute a bond for Rs.10,000/- together with two sureties, of which, one surety shall be a blood relative, the other surety shall possess immovable property; produce the proof of residence and produce the title deed of document for verification. https://hcservices.ecourts.gov.in/hcservices/

4. The learned counsel for the petitioner submitted that none of the relatives of the petitioner would stand as surety for him.

5. The learned Additional Public Prosecutor submitted that the petitioner was apprehended by public, when he tried to rob a passer by of Rs.300/-.

6. In view of the above, the aforesaid condition is modified to the effect that the petitioner shall be released on bail on executing a bond for Rs.10,000/- with two local sureties, who must submit sufficient materials in the stand of the Court and produce their permanent address as well as the address of the petitioner. Rest of the conditions imposed by the Judicial Magistrate No.1, Poonamallee shall remain same. The petitioner is directed to give permanent address to the police and the same shall be verified by the police.
