C.M.P Nos.20882, 20880, 20885 and 20888 of 2021 in C.M.A.No.1328 of 2018 A.A.NAKKIRAN, J.

These four petitions have been filed by the petitioners, i) to condone the delay of 1185 days in filing the petition to set aside the abatement caused on account of death of the sole appellant in the above appeal, ii) to set aside the order of dismissal dated 27.10.2021 made in CMA No.481 of 2018 and restore the same, iii) to set aside the abatement caused on account of death of the sole appellant and iv) to bring on record the legal representatives of the deceased P.Kaliappan, sole appellant namely, 1 ) Saraswathi, 2) K.Balasubramanian as appellants 1 and 2 in the main appeal.

2. The learned counsel for the 2nd respondent has no objection in allowing all the four petitions.

3.Being satisfied with the reasons stated in the affidavits filed in support of these petitions and subject to the interest being waived off for the period of delay of 1185 days, the delay is condoned and all the four petitions are allowed.

4. Registry is directed to carry out necessary amendment and post the main appeal on 11.04.2023.
