O R D E R

This contempt petition has been filed for the alleged disobedience of the order of this Court dated 26.07.2022 made in W.P.No.17581 of 2018.

2. Today when the contempt petition is taken up for hearing, it is submitted by Mr.M.S.Soundara, learned counsel appearing for the petitioner that, though three months time was given by this Court by the said order dated 26.07.2022 to complete the enquiry and pass final orders, no final order has been passed and the enquiry also is not completed, therefore, it is violation of the order of this Court.

3. However, it is brought to the notice of this Court that, during the enquiry, a proceedings has been issued by the Disciplinary Authority on 21.06.2023 stating that enquiry in this matter is over, therefore, final order is going to be passed.

4. Aggrieved over the said order / communication dated 21.06.2023 it has been challenged in the writ petition filed by the petitioner in W.P.No.20502 of 2023, where a learned Judge has granted an order of stay of further proceedings based on the enquiry report.

The said interim order is still subsisting, therefore, the question of violation on the part of the respondent of the order of this Court dated 26.07.2022, in the aforestated circumstances, does not arise. Hence, this Contempt Petition cannot be entertained, therefore, it is closed. 23.08.2023 NCC : Yes / No Index : Yes / No Speaking Order : Yes / No vji To The Deputy Commissioner of Police, Anna Nagar District, Chennai.
