(Order of the Court was made by The Chief Justice) This writ petition has been filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the Hon'ble Debt Recovery Tribunal -III Chennai to pass order in delay application I.A. No.1108 of 2026 in S.A.No.353 of 2026 immediately.

2. Learned counsel for the petitioners submitted that the petitioners have filed Securitisation Application against the measures undertaken by the second respondent bank under Section 14 of SARFAESI Act and against the order dated 17.03.2026 with a delay of 2 days. He submits that the DRT heard the Application for condonation of delay on 09.06.2026, however, orders on the application for condonation of delay had not been passed. He further submits that, in the meanwhile, the respondent bank is trying to take possession and had

threatened to take possession today with the help of police. He, therefore, submitted that the very object of filing the Securitisation Application would become meaningless and sought for indulgence of this court.

3. Considering the fact that though the application for condoning the delay was heard on 09.06.2026, orders are yet to be passed on the same, we direct the respondent bank to maintain the status quo and not to take any coercive action against the petitioners till the application for condonation of delay is decided. We make it clear that we have not entered into the merits of the case.

4. With the above observation, this writ petition is disposed of. No costs. W.M.P.No.26945 of 2026 is ordered subject to payment of separate court fee, if not already paid.
