O R D E R

The Writ Petition has been filed seeking for issuance of Writ of Mandamus to direct the respondents 1 and 2 herein to consider the representation of the petitioner dated 27.09.2023 and grant adequate police protection to the petitioner property comprised in new S.F.No.2/9C, Patta No.575 measuring to an extent of 0.58 cents situated in Perumampatti Village, Salem South Taluk.

2. Heard both sides and perused the materials available on record.

It is seen from the records that there is a civil dispute pending between the petitioner and the private respondents and both the parties have already approached the civil Court and civil suits are pending before the competent Civil Court. Therefore, this Court is unable to entertain this petition, since it is purely civil in nature and the Court cannot direct the Police to give protection to one party when there is rival 2/4

claim over the title. Hence, the Writ Petition is dismissed. There shall be no order as to costs. However, it is open to the petitioner to work out his remedy before the competent Court in pending civil suits. 09.07.2025 Index : Yes/No Speaking Order : Yes/No ms To 1.
