PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 20(b),(ii),(A), 8 (c) of NDPS Act 1985 and Section 77 of Juvenile Justice (Care and Protection of Children) Act, 2015 in Crime No.372 of 2021. Hence, seeks anticipatory bail. 2.The case of the prosecution is that, the respondent police arrested the two juveniles for indulging in selling ganja to the general public. After investigation, they know about the petitioner who sold Kanja pockets through two minor boys. Hence, the respondent police registered a case against the petitioner. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case and he is no way connected in this case. Hence prays for grant of anticipatory bail.

4.The learned Additional Public Prosecution (Puducherry) submitted that the petitioner used the two juveniles for selling Ganja. The investigation is not yet completed against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5.Considering the facts and circumstances of the case and the investigation is not yet completed against the petitioner and the petitioner had used the two Juveniles for selling Ganja. 6.In view of the above facts, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the petition seeking anticipatory bail is dismissed.
