This Contempt petition is filed under Section 11 of the Contempt of Courts Act, praying to punish the respondent for disobeying the directions issued by this Court in M.P.No.1/2010 in W.P.No.12040 of 2008 dated 24.08.2010. For Petitioner : Mr.K.M.Ramesh For Respondent : Mr.J.Ramesh, AGP

ORDER

The Contempt petition is filed to punish the respondents for willful disobedience of the orders of this Court dated 24.08.2010 passed in M.P.No.1 of 2010 in W.P.No.12040 of 2008.

2.The Contempt petition is filed after a lapse of about 9 years, on 08.08.2019. Earlier, the contempt petitioner filed Cont.P.No.1382 of 2011 and the said Contempt Petition was closed by this Court on 25.11.2011. The petitioner

states that he was working thereafter and the respondent has refused to provide work from 01.04.2019. On account of efflux of time, the present contempt petition cannot be entertained after a lapse of 9 years. The facts and circumstances at this length of time are to be considered in the main writ petition and by virtue of an interim order, a contempt petitioner cannot get the relief on filing contempt applications again and again repeatedly. The earlier contempt petition was closed in the year 2011 and now after a lapse of 8 years, the present contempt petition is filed. 3.Though the petitioner states that the respondent has refused to provide work in a particular place, now after a lapse of 8 years, the same cannot be a ground to invoke the contempt jurisdiction so as to punish the respondent.

Such facts and circumstances are to be adjudicated in the main writ petition, so as to redress his grievances. 4.Accordingly, the contempt petition stands closed.
