Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for records relating to
the impugned order in SHRC Case No.6724 of 2018/HCP dated 16th November 2023 and quash the same as violative of principles of natural justice and consequentially direct the 1st respondent to deal with the petitioner complaint dated 14.07.2018 in accordance with law within a time frame.

ORDER
(The order of the Court was made by J.Nisha Banu,J.) This writ petition has been filed challenging the order passed in in SHRC Case No.6724 of 2018/HCP dated 16.11.2023 as violative of principles of natural justice and consequentially direct the 1st respondent to deal with the petitioner's complaint dated 14.07.2018 in accordance with law within a time frame.
2. The case of the petitioner is that the adjacent land owners have put up illegal construction adjacent to the petitioner's house. The illegal construction was removed on the petitioner's complaint. This provoked the adjacent land owners and they started disturbing the petitioner. When the petitioner gave a complaint about the harassment given by them, the 3rd and 4th respondents took the petitioner to illegal custody by receiving a false complaint and harassed the petitioner by placing him in illegal custody in police station. The complaint to the 1st respondent was decided
unilaterally. Hence, the present writ petition with the aforesaid prayer.
3. Heard the learned counsel for the petitioner and perused the materials available on records. Notice to the respondents is dispensed with as no adverse order against them is passed in this writ petition.

It is seen from the records that on the complaint dated 14.07.2018 given by petitioner, the Enquiry Officer has given a detailed report stating that nothing was mentioned about any act of human rights violation and no further action is necessary on the complaint. The 1st respondent/State Human Rights Commission has also dealt with the complaint given by the petitioner in detail and had opined that no further enquiry is required on the complaint under Section 17(i)(b) of the Protection of Human Rights Act, 1993 and had closed the complaint of the petitioner in the year 2023 itself. We do not find any valid reason to interfere with the order passed by the 1st respondent. Therefore, the Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
