ORDER

Pursuant to the earlier order passed on 09.01.2026, the non-bailable warrant has been executed and Mr.R.Muthaiah, Special Sub-Inspector of Police, J-9, Thuraipakkam Police Station, Chennai, produced the judgment debtor before this Court.

2. The judgment debtor stated that he is not aware about any of the proceedings.

3. Such an explanation given by the judgment debtor is far from satisfactory.

4. This Court has already passed an order on 07.11.2025 allowing the application to detain the judgment debtor in civil prison under Order XXI Rule 41(3) of CPC,1908.

5. The matter is listed for hearing today only to enable the police to produce the judgment debtor before this Court to undergo the term in the civil prison.

6. The judgment debtor, who was produced before this Court did not express his intention to repay the amount awarded. In view of the same, the judgment debtor shall be committed to the civil prison and it will be the responsibility of the award holder to pay the subsistence allowance to the judgment debtor as fixed by the State Government. If in the event, the judgment debtor pays the amount of Rs.4,30,02,094/- 2/4

mentioned in the warrant issued by this Court, the Officer in-charge of the civil prison shall release the judgment debtor.

7. If the award holder is otherwise fully satisfied and makes a request for the release of the judgment debtor, he shall be released from the detention by the Officer in-charge of the civil prison, after obtaining an order from this Court.

8. On the omission on the part of the award holder to pay the subsistence allowance, the judgment debtor shall be released from such detention by the Officer in-charge of the civil prison.

9. There shall be a direction to the Registry to issue committal warrant to ensure that the judgment debtor is detained in the civil prison. 21.01.2026 mp Note: Issue order copy today (21.01.2026) along with the orders dated 07.11.2025 and 09.01.2026 3/4
