Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent herein to receive the Application Form CCPA dated 03.08.2016 with prescribed fees and grant the Maxi Cab Permit in respect of the Vehicle Reg. No.TN-07-BK-0213 forthwith.

By consent, the writ petition is taken up for final disposal.

2.The petitioner would state that he is the holder of Contract Carriage Maxi Cab Permit in respect of the vehicle bearing registration no.TN-07-BK-0213 and it is valid upto 29.11.2015. The petitioner would further state that the said permit was cancelled by the respondent on account of non payment of tax for the quarter ending on 30.09.2012 vide proceedings dated 28.09.2012 and according to him, on account of dispute between him and the financier, he could not file an appeal on time and therefore, he approached the respondent along with necessary fees on 03.08.2016, for grant of Maxi Cab Permit afresh and however, it has not been accepted and therefore, came forward to file this writ petition.

3.The learned counsel appearing for the petitioner has drawn the attention of this Court to the common order dated https://hcservices.ecourts.gov.in/hcservices/

18.07.2016, made in W.P.Nos.24610 to 24611 of 2016 and would submit that in similar facts and circumstances, this Court has directed the Regional Transport Officer, Meenambakkam, Chennai - 600 016, to accept the application and give a disposal, within a stipulated time frame and prayed that similar orders may be passed in this writ petition also.

4.This Court also heard the submissions of Mr.K.J.Sivakumar, learned Government Advocate who accepts notice on behalf of the respondent.

5.Though the petitioner prayed for a larger relief, this Court in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the respondent to receive the application, if the papers are otherwise in order and give a disposal, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
