(Order of the Court was made by V.LAKSHMINARAYANAN, J.) This petition has been presented to condone the delay of 138 days in filing the petition to restore W.A.No.3946 of 2004, which had been dismissed on 23.03.2022.

2. This civil miscellaneous petition was filed on 06.09.2022. Rani Ammal, the 1st respondent had passed away on 09.05.2022. This fact is not denied by the learned counsel for the petitioner. Petition filed against a dead person is not maintainable.

3. Hence, this civil miscellaneous petition is dismissed. The petitioner, if so advised, can file a petition to accept the cause title with condonation of delay.
