Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to issue community certificate to the children of the petitioner(1) G.Madhan, (2) G.Kathiravan and (3) G.Kanshika that they belong to "Kattunayakan (ST) Community" based upon the community certificate already issued to the petitioner and her brother and also verified by the State Level Scrutiny Committee in Proceedings No.19341/CV-II/2010-5 dated 28.03.2014. (Order of the Court was made by HULUVADI G. RAMESH,J.) Heard Mr.V.Elangovan, learned counsel for the petitioner and Mrs.M.Lalitha, learned Government Advocate, who accepts notice for the respondent.
2. It is averred in the Writ Petition that the petitioner belongs to Kattunayakan Community, which is classified as Schedule Tribe Community and his brother B.Gunan's communal status was verified by State Level Scrutiny Committee and the State Level Scrutiny Committee, in its finding dated 28.03.2014 had concluded that he belongs to Kattunayakan (ST) Community. The petitioner preferred an application to the respondent on 30.10.2015 requesting to issue community certificate to his children viz., (1) G.Madhan, (2) G.Kathiravan and (3) G.Kanshika that they belong to Kattunayakan (ST) Community. Now, the petitioner is before this court seeking a direction to the https://hcservices.ecourts.gov.in/hcservices/
respondent to issue community certificate to his children.
4. Ms.M.Lalitha, learned Government Advocate, who was directed to take notice for the respondent submits that two months time may be given to the respondent to pass necessary orders.
5. In the light of the said submission, we direct the respondent to consider the application dated 30.10.2015 preferred by the petitioner and verify the aspects as regards the Community Certificate already issued to the petitioner's family members and pass necessary orders regarding issuance of community certificate, in accordance with law, within a period of two months from the date of receipt of a copy of this order.
6. The Writ Petition is disposed of with the above direction. No costs.
