This Contempt Petition has been filed to punish the respondent for the contempt of order of this Court made in W.P.No.19954 of 2021 dated 20.09.2021 . 2.The proceedings through which the petitioner was called for an enquiry, cannot be strictly construed to be a contempt of the order passed by this https://hcservices.ecourts.gov.in/hcservices/ Page No.1/2

Court. This Court directed the respondent to consider the preliminary objection made by the petitioner. The respondent has thereafter called the petitioner for an oral enquiry. The respondent will consider the order passed by this Court and while dealing with the proceedings, the respondent will necessarily take into consideration the preliminary objection made by the petitioner. Therefore, merely because the petitioner has been summoned to appear for an oral enquiry, the same cannot be construed as contempt.

3. In view of the above, this contempt petition is closed. It goes without saying that the petitioner is permitted to attend the enquiry and give his explanation within a period of one week from today.
