ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 8(c) r/w 20 (b)(ii)(B) of NDPS Act in Crime No.2166 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 28.10.2021, the petitioner along with other accused persons were found in illegal possession of 2 kg of ganja. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he had not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submitted that that the petitioner along with other accused persons were found in illegal possession of 2 kg of Ganja. He further submitted that A1 to A4 had already been arrested and remanded to judicial custody and the remaining accused are still absconding. He further submitted that the investigation is at initial stage and the custodial interrogation is very much required. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate (Crl.Side), and also the fact that the investigation is at initial stage, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
