Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents to take appropriate action in shifting the Sludge Treatment Plant and Faecal Sludge Treatment Plant from Perumalsamy Nagar, Gobichettipalayam,
Erode to some other remote locality based on the representation of the petitioner dated 05.06.2023.

ORDER
(Made by the Hon'ble Chief Justice) Heard Mr.Saravana Sowmiyan, learned counsel for the petitioner, Mrs.R.Anitha, learned Special Government Pleader for the second respondent and Mr.B.Anand, learned counsel for the third respondent .
2. Learned counsel for the petitioner submits that the Sludge Treatment Plant is sought to be established in the midst of the residential locality, though there are several lands available in the remote places. The people in the locality have a right to pollution free healthy environment. The setting up of Fecal Sludge Treatment Plant would cause foul smell in the residential locality.
3. Learned counsel for the third respondent, on the instructions of the Commissioner, submits that pumping station and collection well is only constructed in Kabilar Street (lorry stand) near Keeripallam Odai. There is no construction of treatment plant in this site. Perumalsamy Nagar is located opposite side of the road where no construction work is carried out. At present, construction of collection well is in progress. The construction of 4 MLD STP cum 20 KLD FSTP work would be carried out after the completion of biomining in the existing compost yard located at Karatoor.
