JUDGMENT

(Judgment of the Court was delivered by R. SUBRAMANIAN, J.) The appellant questioned the selection of the third respondent for the post of Assistant Grade -1 (C & MM) in the first respondent Unit.

2. Admittedly, the third respondent has acquired more marks than the petitioner in the qualifying examination. The contention of the learned counsel for the appellant is that the third respondent does not possess requisite qualification as per the Advertisement. The requisite qualification as per the Advertisement reads as follows:- A Bachelor's Degree in Science (with Physics, Chemistry & Mathematics) OR Commerce with minimum 50% marks. Please refer para 8 for details of acceptance Bachelor Degree.

8. List of acceptance Bachelor Degrees for the post of Assistant Grade -1 (C&MM):

a) Bachelor of Science (B.Sc) - B.Sc in Physics / Chemistry / Maths b) Bachelor of Science - Honours (B.Sc. Hons.) c) Bachelor of Statistics (B.Stat.)

d) Bachelor of Commerce (B.Com) e) Bachelor of Commerce - Honours (B.Com - Hons.) f) Bachelor of International Business & Finance (BIBF)

3. It is the contention of the learned counsel for the appellant, based on the above qualification, is that the third respondent has not studied Chemistry. The learned counsel would require us to read the qualification prescribed as Bachelor's Degree in Science with subjects of Physics, Chemistry and Mathematics. Therefore, the third respondent having not studied Chemistry in her Under Graduate course, is not qualified for the post.

4. We are unable to read the qualification prescribed in the manner suggested by the learned counsel for the appellant. Apart from specifying the qualification, the Notification also states the list of acceptable Bachelor Degrees, which have been extracted above. The list of acceptable Bachelor Degrees are B.Sc. in Physics / Chemistry / Maths. It is not necessary that a person should have studied Physics, Chemistry and Mathematics in the Under Graduate course. It is enough if he or she possesses a Bachelor's Degree in Science with core subject of Physics or Chemistry or Mathematics. If the interpretation suggested by the learned

counsel for the appellant is applied, then, all candidates, who applied for the post of Assistant Grade-1 (C & MM), should possess three Under Graduate Degrees. Such an interpretation cannot be accepted.

5. Accordingly, this Writ Appeal fails and the same is dismissed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
