Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the respondents 1 to 4 to dispose of the petitioner's representation dated 02.06.21016 by taking action against the 5th and 6th respondents crusher unit namely S.S. Blue Metals.

O R D E R

The petitioner seeks for a mandamus directing the respondents 1 to 4 to dispose of her representation dated 02.06.2016, wherein and whereby, she sought for action against the respondents 5 and 6 by claiming that they are running blue metal unit illegally.

2. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner as it is for the concerned authority to consider the claim of the petitioner and pass orders after hearing both the parties.

3. Now, it is stated before this Court by the learned Special Government Pleader that the R.D.O has already conducted enquiry and appropriate orders will be passed by the District Collector within a short time.

4. Recording the above said submission made by the learned Special Government Pleader, this Writ Petition is disposed of by directing the concerned authority namely, the District Collector Krishnagiri District,to pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, after giving due opportunity of personal hearing to both the parties. No costs.

5. Since the District Collector, Krishnagiri District, is not a party in this writ petition, Registry is directed to mark a copy of this order to the said District Collector. vsi Sd/- Assistant Registrar /TRUE COPY/ Sub-Assistant Registrar
