PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent not to harass the petitioners for notice was issued by the first respondent on the basis of the complaint lodged by the second respondent, which was taken on file by the first respondent as CSR.No.764 of 2021.

O R D E R

This petition has been filed to direct the first respondent not to harass the petitioners for notice was issued by the first respondent on the basis of the complaint lodged by the second respondent, which was taken on file by the first respondent as CSR.No.764 of 2021.

2. The contention of the petitioners is that the petitioners had taken a loan of Rs.1 lakh from one defacto complainant namely, Santhalakshmi, five years before and the same has been settled. Suppressing the same, the said Santhalakshmi had lodged a complaint and CSR.No.764 of 2021 was assigned. The petitioners have called for enquiry and the petitioners though appeared on 10.10.2021, no enquiry was conducted and also they were detained in the Police Station for long hours and later they are harassing the petitioners continuously.

3. The learned Government Advocate (Crl.Side) submits that on the complaint of one Santhalakshmi, CSR.No.764 of 2021 was assigned and for the purpose of enquiry, the petitioners were called, which is termed as harassment.

4. The learned counsel for the petitioners, on instructions, submits that the petitioners will appear before the respondent Police on 06.12.2021 and offer their explanation with supporting materials.

5. In view of the same, the respondent police is directed to proceed in accordance with law.

6. With the above directions, this Criminal Original Petition is disposed of.
