This petition has been filed to modify the condition imposed on the petitioner by an order dated 12.08.2022 in Crl.O.P.No.10607 of 2022 to pay a sum of Rs.2,50,00,000/- (Rupees Two Crores and Fifty Lakhs Only) directly to the de-facto complainant/intervenor by way of demand draft within a period of four weeks from the date on which the order copy made ready.

2. The learned counsel appearing for the petitioner would submit that the petitioner is ready and willing to deposit the said amount to the credit of the crime instead of paying the amount directly to the de-facto complainant.

3. However, this Court while granting anticipatory bail to the petitioner, the petitioner categorically admitted and agreed to pay the amount directly to the de-facto complainant. Therefore, the contention of the petitioner cannot be accepted. However, the payment of the said amount should be accounted for their liability.

4. In view of the above, this Court finds no grounds to modify the condition imposed by this Court in Crl.O.P.No.10607 of 2022. Hence, this Criminal Miscellaneous petition is dismissed. 14.09.2022 mpl https://www.mhc.tn.gov.in/judis
