(i) declaring the Agreement dated 02.11.2002

entered into among defendants relating to property at No.344, Mint Street, Chennai-79 more fully described in the Schedule hereunder as null and void and unenforceable;

(ii) granting a permanent injunction restraining the 1st defendant from making any payment to the defendants two to five jointly or severally or anybody claiming through them, either under the Agreement dated 02.11.2002 or any other pretext;

(iii) directing the defendants to pay the cost of the suit.

JUDGMENT

The learned counsel appearing for the plaintiffs submits that the matter has been settled between the parties. He has also made an endorsement in the Court bundle to that effect.

2. The learned counsel appearing for 5th defendant seeks refund of half of the Court Fee in the name of 5th defendant. He has also made an endorsement to that effect.
