Respondent Writ petition filed under Article 226 of the Constitution of India to issue a writ of Certiorarified Mandamus calling for the records connected with the proceedings issued in Ref.A1/1612/2015 dated 10.06.2015 passed by the respondent herein and quash the same and consequently direct the respondent to reinstate the petitioner into service with all attendant benefits.

By consent, the writ petition is taken up for final disposal.

2. Though the writ petition is filed to quash the order of suspension passed dated 10.06.2015, the learned counsel for the petitioner submitted it would be suffice, if a direction is issued to consider the representation of the petitioner dated 28.09.2015.

3. Mr.s.Ilamvaludhi, learned counsel for the petitioner would submit that while the petitioner was working as a Village Administrative officer, he was placed under suspension by the respondent on 10.06.2015. The Hon'ble Supreme Court in the Judgment reported in 2015 (3) SLR 414(SC) in the case of Ajay Kumar Chowdary Vs Union of India through its Secretary and another, framed guidelines for reviewing the order of suspension, but that is followed in this case. https://hcservices.ecourts.gov.in/hcservices/

4. It is further submitted that the Government issued a letter dated 23.07.2015 based on the Judgment of the Hon'ble Supreme Court for extension of the suspension and the representation of the petitioner may be considered in the light of the Judgment of the Hon'ble Supreme Court .

5. Heard the submissions of Mr.S.Ilamvaludhi, learned counsel appearing for the petitioner and Mr. V.Jayaprakash Narayanan, learned Spl.Govt.Pleader, who accepts notice on behalf of the respondents.

6. This Court, considering the submissions of the learned counsel for the petitioner and without going into the merits, directs the respondent to consider the representation of the petitioner dated 28.09.2015 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order by taking into consideration of the Judgment cited above and communicate the decision taken, to the petitioner.
