2.This application has been filed to bring on record the proposed 6th respondent, who is the Assignee of the trademark of the deceased plaintiff. 3.It is seen from the records that the 1st defendant, who was also set ex-parte in this case and against whom the ex-parte decree was passed, had filed an application to set aside the ex-parte decree, at which point of time, a similar application was filed by the 1st defendant to implead the Assignee of the trademark as the proposed respondent. The said application was allowed and the ex-parte decree was set aside insofar, as the 1st defendant is concerned by an order dated 10.08.2021.
