O R D E R

The relief sought for in this writ petition is for a direction to be issued to the respondents herein to reinstate the petitioner as scavenger in the 3rd respondent Panchayat with all attendant benefits from the date of his appointment.

2. The learned counsel for the writ petitioner states that the writ petitioner was appointed as Scavenger in the 3rd respondent Panchayat on 01.09.1997 and his initial appointment https://hcservices.ecourts.gov.in/hcservices/

was on consolidated pay. The writ petitioner was suffering from certain ailments and on account of treatment, he was not in a position to attend to his duty. However, after discharge from the hospital, the writ petitioner has approached the third respondent for joining duty. The third respondent refused to permit the petitioner in joining duty. In this regard, the writ petitioner has submitted a representation on 14.02.2011 and the same is yet to be considered.

3. Thus, without going into the merits of the case, the second respondent is directed to consider the representation submitted by the petitioner dated 14.02.2011 and pass orders on merits and in accordance with law within a period of eight (08) weeks from the date of receipt of copy of this order.

4. The writ petitioner is directed to enclose a copy of his representation alongwith the order passed in this writ petition. Accordingly, the Writ Petition stands disposed of. However, there shall be no order as to costs.
