Respondents Prayer: Petition is filed under Article 226 of the Constitution of India praying to issue a writ of mandamus, directing the respondents to consider the representation dated 15.6.2009 given by the petitioner and to recognize them as the workers associated with the Pykara Hydroelectric project and to grant them the incentives as awarded to the workers with arrears from the date they were eligible respectively together with interest. Heard the learned counsels appearing on behalf of the parties concerned.

2. At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the respondents had submitted that the petitioner-Organisation may be directed to give a fresh representation to the 3rd respondent, with regard to their claims. The learned counsel had also submitted that such representation would be considered by the 3rd respondent and appropriate orders would be passed thereon, as expeditiously as possible.

3. The learned counsel appearing on behalf of the petitioner has no objection for such an order being passed by this Court.

4. In view of the submissions made by the learned counsels appearing on behalf of the parties concerned, the petitionerOrganisation is directed to give a fresh representation to the 3rd respondent, with regard to their claims, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the 3rd respondent is directed to consider the same and pass appropriate orders thereon, within a period of eight weeks thereafter, after giving an opportunity of hearing to the petitioner, and the other persons concerned, if any. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.
