Prayer: Criminal Original Petition filed under Section 528 of B.N.S.S. to transfer the investigation in Crime No.209 of 2024 for offence under Sections 465, 468, 471 and 420 of IPC pending on the file of 3rd respondent police and transfer the same to the 4th respondent police to investigate and file the charge sheet within the time stipulated by this Court. ORDER
This Criminal Original Petition has been filed to transfer the investigation in Crime No.209 of 2024 registered for the offence under Sections 465, 468, 471 and 420 of IPC pending on the file of 3rd respondent police to the 4th respondent police to investigate the same and to file the charge sheet within the time stipulated by this Court.
2. When the matter came up before this Court on 29.10.2024, this Court passed a detailed order and considering the facts and circumstances of the case, directed the 1st respondent/Commissioner of Police to entrust the investigation 2/6
to the 4th respondent and also directed to take departmental action against the 3rd respondent for dereliction of duty and this matter was ordered to be listed on 20.11.2024 "for reporting compliance". Thereafter, when the matter was listed on 21.11.2024, this Court directed the Commissioner of Police, Coimbatore to appear before this Court on 26.11.2024.
3. Accordingly, today (26.11.2024), Mr.V.Balakrishnan, Commissioner of Police, Coimbatore, appeared before this Court and also filed the action taken report and it was submitted that the directions of this Court dated 29.10.2024 has been complied with. The same is recorded.
4. The 4th respondent police is directed to complete the investigation and file final report as early as possible.
5. Accordingly, this Criminal Original is disposed of.
6. The grievance of the learned counsel for the petitioner in Crl.M.P.No.16294 of 2024 is that without impleading the petitioner in the said Miscellaneous Petition, behind his back orders has been passed for transfer of 3/6
investigation on 29.10.2024. However, now the order of this Court dated 29.10.2024 has been complied with and the investigation has also been transfered from the file of 3rd respondent to 4th respondent. Hence, the Crl.M.P.No.16294 of 2024 is closed. The petitioner in the said Miscellaneous Petition is directed to work out his remedy in the manner known to law. 26.11.2024 Index : Yes / No Speaking Order : Yes / No ksa-2 4/6
