C.M.P.No.27730 of 2019 in A.S.No.1029 of 2019 RMT.TEEKAA RAMAN,J.

The unsuccessful plaintiff is the appellant herein. He filed in O.S.No.46 of 2013 on the file of the learned V Additional District Judge, Coimbatore for partition.

2. The respondent is the defendant filed a written statement alleging that the properties have already been sold by 1st respondent on behalf of the minors and the suit was dismissed, hence the appeal.

Pending appeal, the plaintiff seeks injunction.

4. As on date, the defendant is the owner of the property and during the trial, they had the benefit of injunction, hence, I am not inclined to grant any relief in the above C.M.P.

5. Accordingly, C.M.P.No.27730 of 2019 is closed.
