Mr.P.Tamizh Kumaran, learned counsel on record for the applicant / petitioner and Ms.A.Saranya of M/s.Iyer and Thomas (Law Firm), on behalf of Respondents 1 and 2 are before this Court.

2. In the main 'Original Petition' ('OP' for brevity) i.e., O.P.No.161 of 2018, third respondent V.Rajendran died pending proceedings and this Court is informed that the date of demise is 17.02.2019. This has necessitated the filing of instant application by the petitioner in the main OP. To be noted, prayer in instant application is to bring on record the legal heirs of deceased third respondent (V.Rajendran), who are Respondents 4 and 5, in the instant application. To be noted, third respondent herein R.Padma, who is already a co-respondent i.e., fourth respondent in the main OP, is deceased third respondent's spouse and she shall also be recorded as one of the legal heirs of deceased third respondent in the main OP.

3. Learned counsel, who is already appearing for Respondents 1 to 3 in instant application, who are Respondents 1, 2 and 4 respectively in 1/3

the main OP, submits that she has instructions from Respondents 4 and 5 herein (R.Satish Raj and Ganesh Raj). On such instructions, learned counsel submits that, this application being innocuous, but imperative, is not opposed.

4. In the light of aforesaid trajectory, instant application is ordered as prayed for. Learned counsel for applicant/petitioner to carry out necessary and consequential amendments in the case file within a fortnight from today i.e., on or before 19.12.2019. Instant application is ordered as above.
