Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order of the respondent in Na.Ka.A3.3575/2004 dated 12.06.2004 and in Na.Ka.No.A3.3575/2004 dated 30.04.2006 and quash the same and direct the respondent to reinstate the petitioner in service with all consequential benefits.

O R D E R

The petitioner has filed this writ petition challenging the suspension order passed by the respondent under Rule 17(c) of the Government Servants Conduct Rules and the order passed by the respondent detaining the petitioner in service.

2.The learned counsel appearing for the petitioner would submit that subsequent to the filing of the writ petition, the criminal case ended in acquittal and no disciplinary proceeding was initiated consequent to the criminal case. Hence, in view of the acquittal, the petitioner may be granted liberty to make a representation to the respondent for appropriate relief.

3.Heard both sides.

4.In view of the above, this Court without going into the merits of the case, grants liberty to the petitioner to make a representation to the respondent within a period of two weeks from the date of receipt of a copy of this order and on receipt of such representation, the respondent shall pass orders on the same, in accordance with law, within a period of twelve weeks thereafter.

5.The writ petition is disposed of accordingly. No costs.
