Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records of the respondent dated 21.08.2016 and quash the same and consequently directing the respondent to allow the petitioner to conduct Adal Padal programme in Thengalpalayam Arulmigu Sree Thalamuniyappan Temple Festival dated on 30.08.2016.

By consent, this Writ Petition is taken up for final disposal.

The petitioner claims to be the Secretary of the Temple festival committee of Thengalpalayam Arulmigu Sree Thalamuniyappan Temple, situate at Thengalpalayam Post, Rasipuram Taluk, Namakkal District. He submitted an application dated 21.08.2016, to the respondent praying for necessary permission to conduct a cultural event in connection with the temple festival, which includes song and dance programme and vide impugned order dated 22.08.2016, it was rejected and challenging the legality of the same, came forward to file this writ petition.

3. The learned counsel appearing for the petitioner would submit that the respondent without assigning any reason whatsoever, has simply rejected the application and prays for appropriate orders.

4. Heard the submission of Mr.A.N.Thambidurai, learned Special Government Pleader, who accepts notice on behalf of the respondent.

5. On perusal of the impugned order passed by the respondent would disclose that no reason has been assigned as to the rejection of the application submitted by the petitioner for conducting the said programme. Therefore, this Court is of the view that the impugned order warrants interference.

6. In the result, this Writ Petition is partly allowed and the impugned order passed by the respondent dated 22.08.2016 is quashed and this Court without going into the merits of the same, directs the respondent to re-consider the application and pass appropriate orders in accordance with law as expeditiously as possible not later than one week from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
