PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to release the TATA ACE van bearing Regn.No.TN-70-D2991 forthwith by accepting the provisional fine. For Petitioner :

ORDER

Mr.S.Diwakar, learned Special Government Pleader accepts notice for the respondents. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner seeks a direction to the respondents to release the TATA ACE van bearing Regn.No.TN-70-D-2991, which has been seized and is now in the custody of the first respondent for the violation committed by the petitioner as per the vehicle inspection record (check report dated 23.7.2016). The petitioner has accepted her guilt and given a representation stating that she is willing to pay appropriate fine and prays that the vehicle may be released.

3. Accordingly, the writ petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 8.8.2016 on merits and pass appropriate orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.
