ORDER
This Criminal Miscellaneous Petition has been filed to condone the delay of 183 days in filing the criminal appeal against the judgment dated 09.10.2025 made in Spl.S.C.No.08 of 2023 on the file of the Fast Track Mahila Court, Udhagamandalam and consequently take the Criminal Appeal on file.
2. The learned counsel for the petitioner submitted that the petitioner was
convicted by the trial Court in Spl.S.C.No.8 of 2023 on the file of the Fast Track Mahila Court, Udhagamandalam, and is presently in confinement. As a result, the petitioner was unable to contact either his family members or his counsel, leading to a delay of 183 days in filing the criminal appeal.
3. Mrs.Sharada Vivek, learned Government Advocate (Crl. Side) appearing for the respondent police submitted that, since this is a statutory appeal, there is no serious objection to this petition being allowed.
4. Heard both sides.
5. Considering the submission made by the learned counsel on either side and having perused the affidavit filed in support of this petition, this Court is satisfied that the petitioner has made out sufficient cause. Accordingly, this Civil Miscellaneous Petition is ordered.
6. The Registry is directed to number the criminal appeal, if it is otherwise in order.
