Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to consider the alternative route for procession of Poosoorithal dated 28.08.2016, based on the petitioner representation dated 16.08.2016. By consent, this Writ Petition is taken up for final disposal.
2. Facts leading to the filing of this writ petition have been narrated in detail in the earlier order dated 26.08.2016.
3. The learned counsel appearing for the petitioner would submit that because of heavy rains and bandobasth, the procession went on peacefully and the apprehension expressed https://hcservices.ecourts.gov.in/hcservices/
by the petitioner is that under the guise of procession, some slogans will be raised against people belonging to particular religion, which may lead to law and order problem and only to prevent the same, the petitioner is constrained to file this writ petition and prays for appropriate orders.
4. Per contra, Mr.R.Govindasamy, learned Special Government Pleader appearing for the respondents 1 to 4 has drawn the attention of this Court to the Status Report of the first respondent dated 29.08.2016 and would submit that the procession was monitored by police officials and the concerned police officials visited the area and closely watched the same and maintained law and order and the Inspector General of Police, Central Zone, Tiruchirapalli, DIG of Police, Thanjavur have also stationed at Tanjore for this purpose and the procession went on peacefully without any untoward incident.
5. In the light of the above said Status Report of the first respondent, nothing survives for adjudication as on today. Therefore, this Writ Petition is closed. However, it is made clear that the official respondents shall make every endeavour to maintain law and order problem and public order in the event of any permission is granted for conducting public procession and based on the application submitted by people belonging to different religion/sect/community, as the communal harmony is the need of the hour.
