ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 23.09.20211 for the offences under Sections 395 and 397 of IPC, in Crime No.328 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 15.09.2021, when the defacto complainant along with his company people was proceedings towards Santhamangalam, the accused persons who came in three two wheelers waylaid the defacto complainant, broken the front glass of the car and snatched Rs.30 lakhs and a cell phone from him. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for more than 60 days from 23.09.20211 and hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that out of Rs.30 lakhs, only about Rs.20 lakhs has been recovered and the remaining amount is yet to be recovered. 5.On seeing the grave nature of offence and the investigation has not been completed and that only a part amount has been recovered, this Court is not inclined to grant bail to the petitioner.
