By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the 4th respondent is dispensed with.
2. This Writ Petition has been filed for issuance of writ of certiorari to call for the records in Power of Attorney Document No. 188/2012 dated 12.09.2012 and Sale Deed No.4971/2020 dated 30.12.2020 on the file of SRO, Ayothiyapattinam and quash the same.
3. It is stated by the learned counsel for the petitioner that suit in O.S. No. 63 of 2022 is pending on the file of District Munsif cum Judicial Magistrate, Valapadi. It is submitted that the very idea behind filing the present writ petition was that the suit has been pending for a while that there has not been any progress. 2/4
4. At the outset, Mr.U.Baranidharan, learned Special Government Pleader appearing for the respondents 1 to 3 would submit that there can not be two parallel remedies and having availed remedy by instituting a suit, it may not be appropriate for this Court to entertain this writ petition.
5. I find there is merit in the submissions of the learned counsel for the respondent.
6. Learned counsel for the petitioner would only submit that the hearing of the suit by the civil Court may be expedited.
7. In view of the same, this Writ Petition is dismissed. Consequently, connected miscellaneous petition is closed. No costs.
8. However, it is up to the petitioner to move an appropriate petition before the Civil Court for expediting the hearing in the above suit. 15.07.2025 Index: Yes/No AT 3/4
