ORDER

The prayer sought for in the present petition is to call for the records in C.C.No.2/2010 pending on the file of the learned Judicial Magistrate No-1, Vellore for offences under sections 498 (A), 406, 494, 294 (b) and 506 (i) of IPC read with section 4 of Dowry Prohibition Act and quash the same.

2. It is submitted by the learned Government Advocate, on instructions, that the trial has already commenced and that out of 8 witnesses, 7 witnesses have been examined.

3. Various grounds have been raised by the petitioners touching upon the factual aspects. In my view, it is always open https://hcservices.ecourts.gov.in/hcservices/

to the petitioners to raise all their grounds during the course of trial and arguments. It would not be appropriate of this court to interfere with the proceedings, at this stage, especially when the trial has already commenced and that out of 8 witnesses, 7 witnesses have been examined.

4. In the result, the Criminal Original Petition is closed with liberty to the petitioner to raise all the grounds during the course of the trial and arguments.
