ORDER

The prayer sought for herein is for a writ of mandamus directing the respondents to consider the representations of the petitioner dated 24.01.2022 and 18.07.2022 to set aside the suspension order dated 04.01.2022 issued by the 2nd respondent.

2. The petitioner has been working as a Supervisor at the second respondent Society. while so, he was arrested pursuant to the trap case set by the DVAC. Therefore, by order dated 05.01.2022, the petitioner has been placed under suspension with effect from 04.01.2022.

3. The petitioner since has been suspended from 04.01.2022 i.e., for the past about nine months, he has given a request to the respondents on 16.08.2022 to review such suspension and the same since has not been considered, the petitioner has moved the present writ petition.

4. Heard Mr.T.Sundaravadanam, learned counsel appearing for the petitioner and Mr.R.U.Dinesh Raj Kumar, learned Additional Government Pleader appearing for the respondents.

5. In respect of the suspension case, especially, the DVAC cases are concerned, how the suspension case especially, the long pending cases have to be dealt with have been considered by the Government and they have issued the set of guidelines in G.O(Ms.).No.81, Human Resources Management (N) Department, dated 04.08.2022.

6. In view of the said guidelines issued by the Government, this Court feels that a direction can be given to the respondents to consider the request of the petitioner for review of his suspension in the light of the Government Order referred to above.

7. In that view of the matter, this Court is inclined to dispose of this writ petition with the following order:

That there shall be a direction to the second respondent to consider the request of the petitioner dated 16.08.2022 for review of the suspension of the petitioner in the light of the mandatory guidelines issued by the Government through G.O.(Ms.).No.81 referred to above and pass orders thereon on merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.
