ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents to consider the representation made by the petitioner on 29.05.2025 and to issue birth certificate to the petitioner. 2.

Heard Mr.K.Indumathy Venkatesh, learned counsel for the petitioner and Mr.G.Velu, learned Additional Government Pleader for respondents 1 to 3.

The case of the petitioner is that he was born on 10.01.1993 and the birth took place in his residence. The parents of the petitioner did not apply for any birth certificate. In the school certificate, the date of birth of the petitioner has been mentioned as 10.01.1993. The petitioner approached the Block Medical Officer, District Primary Health Center, Ellapuram Division, Periyapalayam, for the issuance of birth certificate. The petitioner was informed that the relevant records have been sent to the revenue department.

Thereafter, the petitioner was co-ordinating with the revenue Department. The grievance of the petitioner is that his representation is pending from 29.05.2025 and no decision has been taken. It is under these circumstances, the present writ petition has been filed before this Court.

When the matter was taken up for hearing, the learned Additional Government Pleader produced the written instructions received from the 3 rd respondent. On going through the same, it is seen that the petitioner has submitted a non-availability certificate in the year 1993 and whereas the 3 rd respondent is asking for non-availability certificate from 1994 to 2025 which can be given by the Sub-Registrar office, Arani, after making necessary payment. An affidavit can also be given by the petitioner in this regard. The final enquiry has been fixed on 25.07.2025 before the 3 rd respondent. If the petitioner is able to produce the relevant documents, the 3 rd respondent will deal with the application and give the birth certificate to the petitioner. 5.

In the light of the above stand taken by the 3 rd respondent, it is left open to the petitioner to submit all the necessary documents before the 3 rd respondent and participate in the enquiry on 25.07.2025 and if the petitioner satisfies all the requirements, there shall be a direction to the 3 rd respondent to issue the birth certificate to the petitioner. This process shall be completed within a period of six weeks from the date of receipt of the copy of this order.

This writ petition is disposed of with the above directions. No costs.
