Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 4 to conduct an enquiry, take action against the fifth respondent and cancel the patta bearing No.11835 dated 16.06.2020 of the fifth respondent in accordance with law, based on the petitioners' representation dated 23.09.2020 in respect of the fraudulent transactions made in the land measurements of the petitioner's property situated at No.98, Pozhichalur Village, situated in Pozhichalur, Chennai comprised in Old Survey No.212/1A (New S.No.212/6A2).

ORDER
This Writ Petition is filed to issue a Writ of Mandamus, directing the respondents 1 to 4 to conduct an enquiry, take action against the fifth respondent and cancel the patta bearing No.11835 dated 16.06.2020 of the fifth respondent in accordance with law, based on the petitioners' representation dated 23.09.2020 in respect of the fraudulent transactions made in the land measurements of the petitioner's property situated at No.98, Pozhichalur Village, situated in Pozhichalur, Chennai comprised in Old Survey No.212/1A (New S.No.212/6A2).
2. The petitioner is challenging issue of patta in favour of the fifth respondent before the fourth respondent. The appeal remedy is available before the concerned Revenue Divisional Officer as against the issuance of patta in favour of the fifth respondent.
3. Considering the limited relief sought for in the petition, without expressing any opinion on merits of the writ petition, the petitioner is directed to submit a fresh appeal before the concerned Revenue Divisional Officer within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the concerned Revenue Divisional Officer is directed to conduct enquiry, after issuance of notice to the petitioner and the fifth respondent and also counter parties, if any after giving opportunity of hearing to them and pass orders on merits and in accordance with law within a period of twelve weeks thereafter.
4. With the above direction, this Writ Petition is disposed of. No costs.
