O R D E R
This writ petition has been filed to direct the respondents 1 to 4 to enquire into the irregularities and corruption committed in the Sozhavandhipuram Panchayat and take appropriate action based on the petitioner's representation dated 28.09.2024.
2. The petitioner is the resident of Manapoondi Village and the President of "Nagarvor Paathukappu & Pothuvudamai Vizhipunarvu Arakattalai". The petitioner as the President of the Trust collected evidence regarding the misappropriation of funds in the Sozhavandiputam village, relating to discrepancies in disbursal of funds under the Swachh Bharat mission and irregularities committed in the allotment of 100 days employment scheme. The petitioner submitted representation to the respondents 1 to 3, on 28.09.2024 and 14.10.2024, along with supporting 2/5
documents for necessary action against the persons involved in the misappropriation of Government funds. Pursuant to the representation, the first respondent passed an order on 13.11.2024, appointing the 4th respondent as the enquiry officer with direction to the 4th respondent to submit the enquiry report to him. Subsequently, the petitioner submitted representations to the 4th respondent on 27.11.2024 and 22.12.2024, requesting to conduct investigation, on the irregularities complained by him. Meanwhile, the 4th respondent also sought for certain documents from the 3rd respondent. Thereafter, the 4th respondent sent a letter to the petitioner on 15.02.2025, calling the petitioner to appear for enquiry on 20.02.2025, at 11.30am. Thereafter, till date no action was taken and hence, the petitioner filed the present writ petition.
3. Heard the learned counsel for the petitioner and the learned Special Government Pleader for respondents 1, 2 and 4 and learned Government Advocate for R3. With consent of both parties, this writ petition is taken up for final disposal.
4. Considering the facts and circumstances of the case and in view of the fact that the 4th respondent has already initiated proceedings pursuant to 3/5
the letter of the first respondent dated 13.11.2024, a direction is issued to the 4th respondent to complete the enquiry and submit the report to the first respondent, within a period of eight weeks, from the date of receipt of a copy of this order. On receipt of the enquiry report of the 4th respondent, the first respondent shall take appropriate action, as necessary, in accordance with law.
