Respondents PRAYER: This Writ petition came to be numbered under Article 226 of the Constitution of India by way of transfer of O.A.No.1849 of 2003 from the file of the Tamil Nadu Administrative Tribunal praying for a Writ of Certiorarified Mandamus, to call for the records of the 1st respondent relating G.O.Ms. No.82 Environment and Forests (FR.I) Department dated 06.05.2003, quash the same and consequential orders and issue directions to the respondent herein to allow the applicant to continue to serve as Assistant Conservator of Forests and pass further orders.

O R D E R

The petitioner filed O.A. No. 1849 of 2003 before learned Tamilnadu Administrative Tribunal, which came on transfer to this Court as Writ Petition No.17284/2007, seeking for a prayer to issue a Writ of Certiorarified Mandamus, to call for the records of the 1st respondent relating G.O.Ms. No.82 Environment and Forests (FR.I) Department dated 06.05.2003 and to quash the same, with a consequential direction to the respondent to allow him to continue to serve as Assistant Conservator of Forests.

Mr. N. Inbanathan, learned Government Advocate (Forests) submitting a letter of the Principal Chief Conservator of Forest, Chennai addressing the Special Government Pleader (Forests) in L2/19466/2011 dated 16.12.2014, stated that when the petitioner went to learned Tamilnadu Administrative Tribunal challenging the impugned order cancelling the promotion of the petitioner, interim stay of the cancellation order was granted and during the currency of the order of stay the petitioner had retired from service on reaching the age of superannuation. As a result, he pleaded that nothing survives in the writ petition.

3. Learned counsel appearing for the petitioner was also served with a copy of the letter. The proceeding dated 16.12.2014 is placed on record.

4. Since the petitioner had retired from service as Assistant Conservator of Forests, nothing survives in the writ petition. Therefore, the Writ Petition is closed. No order as to costs.
