The Writ Petition in W.P.(MD) No.11998 of 2024 has been filed by the Management. However, the review application has been filed by the first respondent stating instead of giving a direction to the Assistant Commissioner of Labour to decide about the factual aspect of the relationship between the petitioner and the first respondent as an employeeemployer, the direction ought to have been given to the second respondent / appellate authority.

2. The learned counsel for the petitioner further submitted that earlier the very same issue was decided by the second respondent and he has given a categorical finding as to the existence of the employee and employer relationship and hence, the very same issue need not be agitated before the Assistant Commissioner of Labour against whom a direction has been given.

3. At the request of the learned counsel for the second respondent to file counter, if any, or to get instructions, list the matter on 24.02.2025 under the caption "for orders".
