ORDER

The present wit petition has been filed with a prayer for Mandamus,to direct the respondents to recalculate and disburse the differential amount of gratuity and earned leave liability, along with interest, in accordance with the 12(3) Settlement implemented on 01.09.2019 and to direct the respondents to settle the leave surrender benefit for 15 days for the year 2018, along with interest from the due date till the date of actual payment, within the stipulated time.

The learned counsel appearing on behalf of the petitioner submits that the petitioner was retired from service on 30.04.2020, and his retirement benefits has been computed based on the Pre-evised Pay Scale. The learned counsel further submits that the petitioner is entitled for Revised Pay Scale as per 12(3) Settlement. Hence, the petitioner has sent a representation on 03.10.2024 and such representation is pending with the respondent.

3. At this juncture, the learned Standing Counsel appearing on behalf of the respondents fairly submitted that they will consider the petitioner's above representation dated 03.10.2024 and pass orders according to its own merits and in accordance with law within a reasonable time. 2/4

4. Heard the learned counsel on either sides and also perused the materials available on record.

5. In such view of the fair submission made by the learned Standing Counsel, without going to the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's above representation dated 03.10.2024 and pass orders, according to its own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. With the above observations, the Writ Petition stands disposed of. No costs.
