The petitioner/A2 is an accused in Crime No.83 of 2023 registered by the respondent police on 23.03.2023 for the offences punishable under Sections 22(c), 25 and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985, and he was arrested and remanded to judicial custody on 23.03.2023. Hence, he seeks bail.

2. It is stated that based on the secret information, the accused/A1 and A2 had been arrested. The learned counsel for the petitioner stated that the 2nd accused/petitioner herein had been arrested only on the basis of the confession statement of the 1st accused.

3. It is contended by the learned Government Advocate (Crl. Side) for the respondent. Both the accused did not state that they were not known to each other. It is stated that they were in conscious possession of 9 packets of Methamphetamine (each packet contains 800 gms) tablets and the vehicle and mobile phone have already been seized and charge sheet has not been filed and the trial is in progress.

4. Considering the facts and circumstances and taking note of the fact that there are previous cases against the petitioner herein and the investigation has not been completed, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this criminal original petition is dismissed. 03.10.2023 ata
