The Petitioners, who apprehend arrest at the hands of the Respondent police for the offence punishable under Sections 341, 448, 384, 506(i), 109 of IPC and 3 of Public Property (Prevention of Damage & Loss) Act, 1992 in Crime No.203 of 2023 on the file of the Respondent police, seeks anticipatory bail.
2.The case of the prosecution is that on 19.07.2023 the Petitioners and other accused assembled the defacto-complainant/Mr.Haridoss's shop and accumulated the construction materials in front of the defacto complainant's shop and harassing the defacto complainant. Hence this complaint. 3.The learned Counsel for the Petitioner would submit that the Petitioners are innocent. The defacto-complainant constructing the building without proper permission from the Government and constructed the shop in the street. Due to civil dispute between the Petitioners and the Defacto Complainant, false case was registered against these Petitioners and the Petitioners are no way connected with the alleged crime. Hence, the learned counsel for the Petitioners prays for grant of anticipatory bail to the Petitioners.
4. The learned Government Advocate (Crl. Side) for the Respondent would submit that the Petitioners dumped construction materials in front of the 1/ 3
shop of the Defacto Complainant. He vehemently opposed to grant anticipatory bail to the Petitioner.
5.Heard both sides and perused the materials available on record. 6.Taking into consideration the submissions made by the learned counsel on either side and the facts of the case and nature of the offences, I am not inclined to grant Anticipatory Bail to the Petitioners. Accordingly, this Criminal Original Petition is dismissed.
