O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 4(1)(C) of the Tamil Nadu Prohibition (Amendment) Act, 2024 & Section 24 of TNP Act, in Crime No.343 of 2025, on the file of the respondent Police, seeks anticipatory bail. 1/4

2. The case of the prosecution is that, as per the instruction of the petitioner/A2 herein, who was the bar contractor, the first accused sold the TASMAC liquor bottles to the public at an inflated price beyond the permitted working hours. Fourteen liquor bottles were seized from the first accused. Hence the case.

3. The contention of the petitioner is that the petitioner is innocent and has been falsely implicated in this case. He also submitted that without the petitioner's knowledge, the first accused had indulged in this crime and the petitioner is in no way connected with the aforesaid offence. He further submitted that the petitioner was implicated in this case only based on the confession statement recorded from the first accused. Hence, he prayed for the grant of anticipatory bail.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for granting anticipatory bail to the petitioner/A2.

5. Heard both sides and perused the materials available on record. 2/4

6. Considering the submissions made by the learned counsel appearing on either sides and taking note of the nature of the allegations committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
