Appellant /versus/ Mr.Sargunam ..

Respondent This case is taken up for settlement before this Lok Adalat. Both parties are present. Mr.A.Parthasarathy, learned counsel for appellant and M/s.K.Kavya, learned counsel for the respondent are present.

JUDGMENT

When the matter was called, the learned counsel for the appellant submitted that the Deputy Commissioner of Labour, Coimbatore, has awarded a sum of Rs.2,50,404/- with 12% interest which comes to a sum of Rs.3,53,521/- and the same has been deposited to the credit of E.C.No.13 of 2019. Hence, nothing survives in this matter for further adjudication and sought permission of this Court to withdraw the appeal and he has also made an endorsement to that effect in the case bundle.

2. Learned counsel for the respondent submitted that 50% of the amount has already been withdrawn by the respondent and now he sought permission of this Court to withdraw the remaining 50% of the amount.

3. In view of the submission coupled with an endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Appeal is dismissed as withdrawn and the respondent/claimant is permitted to withdraw the remaining 50% of the amount which was deposited to the credit of E.C.No13 of 2019.
