No. 17330 of 2007 : This Writ petition came to be numbered under Article 226 of the Constitution of India by way of transfer of O.A. No. 3803 of 2003 from the file of the Tamil Nadu Administrative Tribunal praying for a Writ of Certiorarified Mandamus, to call for the records pertaining to the G.O. (D) No.1309 Health and Family Welfare Department dated 28.10.2003 on the file of the first respondent and quash the same and direct the respondents to permit the applicant to retire from service with all consequential retirement benefits including the arrear of pay payable to the applicant as per the III Pay Recommendation and other attendant benefits and pass further orders. PRAYER in W.P. No.
17331 of 2007 : This Writ petition came to be numbered under Article 226 of the Constitution of India by way of transfer of O.A. No. 3804 of 2003 from the file of the Tamil Nadu Administrative Tribunal praying for a Writ of Certiorari, to call for the records pertaining to the charge memo dated 17.04.2003 in Ref. No9. 86658/SC1/1/02 issued by the 2nd respondent and quash the same and pass further orders.

The petitioner had filed two Applications in O.A. Nos. 3803 and 3804 of 2003 and both of them took transferred to this High Court as W.P. Nos. 17330 and 17331 of 2007.
2. The first Writ Petition has been filed challenging the suspension order dated 28.10.2003 issued in G.O. (D) No.1309 Health and Family Welfare Department and the second writ petition has been filed challenging the charge memo dated 17.04.2003 issued under Rule 17(b) of the Tamilnadu Civil Services (Discipline and Appeal) Rules. The record also shows that no order of stay has been passed either against the order of suspension or against charge memo.

However, learned counsel appearing for the petitioner fairly stated that inspite of repeated steps taken, the petitioner has not responded. Therefore, as there is no instruction from the petitioner to proceed with the matter, the Writ Petitions are dismissed for no instructions. No order as to costs.
