Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorari, to call for the records passed by the second respondent in proceedings P.R.49 of 2003 dated 19.11.2003, quash the same.

Heard both sides.

2. The impugned order of compulsory retirement inflicted against the petitioner-Mr.N.S.Thangapandian by the second respondent-Deputy Commissioner of Police, Crime and Traffic, Madurai in P.R.No.49 of 2003 dated 19.11.2003 was put to challenge in O.A.No.4218 of 2003 before the Tamil Nadu Administrative Tribunal, Chennai. The matter came on transfer and renumbered as the present writ petition. https://hcservices.ecourts.gov.in/hcservices/

In the meanwhile, the petitioner, during the pendency of the matter, preferred an appeal on 1.12.2003 before the first respondentCommissioner of Police, Madurai, who modified the punishment of compulsory retirement into one of reduction in pay by three stages for three years with cumulative effect on 5.1.2004. Once again, on filing of review petition dated 21.1.2004, the Additional Director General of Police, Law & Order, Chennai in his proceedings in Rc.No.PR.2(3)/035627/04 dated 15.4.2004, has further modified the punishment into one of reduction in pay by one stage for one year without cumulative effect. Consequent on the modification of punishment, the petitioner was also reinstated in service on 6.1.2004. Thereafter, he retired from service on reaching the age of superannuation on 30.6.2012.
